Terms & Conditions of Sale

These General Terms and Conditions of Sale ("Terms") govern all sales of products made through the website shopdelvo.com between XIN SHI 88 SRL (the "Seller") and its customers (the "Customer"). They are drawn up in accordance with Directive 2011/83/EU on consumer rights, Directive (EU) 2019/771 on the sale of goods, Directive 2000/31/EC on electronic commerce and the Italian Consumer Code (Legislative Decree 206/2005). Please read them carefully before placing an order.

2. Scope

These Terms apply to Customers who are consumers, i.e. natural persons acting for purposes outside their trade, business, craft or profession. The version in force at the time the order is placed applies to that order. The Terms can be saved and printed from this page.

3. Products

The main characteristics of each product are described on its product page. Images are for illustrative purposes; minor differences in colour or packaging do not affect the essential characteristics of the product. All products are offered while stocks last.

4. Prices

Prices are shown in the currency indicated on the product page and include VAT and any other applicable taxes. Delivery is free of charge, unless otherwise stated on the product page before the order is placed. The total price to pay is shown before you submit your order and is confirmed during the confirmation call.

5. How the contract is concluded

  1. You fill in the order form on the product page with your name, telephone number and delivery address, and submit it with the order button. Before submitting, you can check and correct the data you have entered.
  2. Submitting the form is an order request. Within 24 working hours, one of our operators will call you to confirm the product, quantity, total price and delivery address.
  3. The contract is concluded when you confirm the order during the call. If we cannot reach you, or you do not confirm, no contract is concluded and you owe nothing.
  4. On request, we will send you a confirmation of the contract by email or text message.

The contract is concluded in the language of the website version you are using.

6. Payment

Payment is made in cash on delivery: you pay the total amount directly to the courier when you receive the parcel. No advance payment and no payment card details are required.

7. Delivery

Products are delivered to the address you indicated, normally within 24–48 working hours of the order confirmation, and in any case no later than 30 days from the conclusion of the contract. Full details are set out in our Shipping Policy. The risk of loss or damage passes to you only when you, or a person indicated by you other than the carrier, take physical possession of the products.

8. Right of withdrawal

As a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. XIN SHI 88 SRL voluntarily extends this period to 30 days from the day on which you, or a third party indicated by you other than the carrier, take physical possession of the products. Conditions, procedure, the model withdrawal form and the statutory exceptions are set out in our Refund & Returns Policy, which forms an integral part of these Terms.

9. Legal guarantee of conformity

All products are covered by the legal guarantee of conformity provided by Directive (EU) 2019/771 and Articles 128 et seq. of the Italian Consumer Code. The Seller is liable for any lack of conformity that exists at the time of delivery and becomes apparent within 2 years of delivery. Any lack of conformity that becomes apparent within one year of delivery is presumed to have existed at the time of delivery, unless proven otherwise.

In the event of a lack of conformity, you are entitled to have the product brought into conformity free of charge by repair or replacement, at your choice, unless the remedy chosen is impossible or would impose disproportionate costs on the Seller. If repair or replacement is not possible, is not carried out within a reasonable time, or the defect persists, you are entitled to a proportionate price reduction or to terminate the contract and obtain a full refund. To make a claim, write to info@shopdelvo.com, describing the defect and, if possible, attaching photos. The legal guarantee is in addition to, and not affected by, the right of withdrawal or any commercial guarantee.

10. Liability

The Seller is not liable for damage resulting from use of the products that does not comply with their instructions or intended purpose, or for delays or failures caused by events beyond its reasonable control (force majeure). Nothing in these Terms excludes or limits the Seller's liability where this is not permitted by law, in particular for death or personal injury caused by negligence, for fraud, for defective products under Directive 85/374/EEC, or the rights granted to consumers by mandatory law.

11. Personal data

Personal data is processed in accordance with our Privacy Policy and Cookie Policy.

12. Complaints and dispute resolution

For any complaint, contact our customer service at info@shopdelvo.com: we will reply within 7 working days. If a dispute cannot be resolved directly, you may contact an out-of-court dispute resolution (ADR) body competent in your country or ask the European Consumer Centre in your country for assistance (ECC-Net). The Seller is not obliged to participate in ADR proceedings unless required by the law of your country. Please note that the EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025.

13. Governing law and jurisdiction

These Terms are governed by Italian law. If you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence (Art. 6 of Regulation (EC) 593/2008). Consumers may bring proceedings before the courts of their place of residence or domicile; the Seller may bring proceedings against a consumer only before the courts of the consumer's place of residence or domicile (Regulation (EU) 1215/2012).

14. Changes to these Terms

The Seller may amend these Terms at any time. Changes do not apply to orders already confirmed.
